1. Introduction

These Terms of Service govern your access to and use of the products, services, platforms, servers, hosting solutions, VPN services, cloud services, game servers, cloud office solutions, and any related services provided by Point of Trade Co. / Cloud Service Provider.

By placing an order electronically through our website, client area, order form, or any related platform, you confirm that you have read, understood, and agreed to these Terms of Service.

If you do not understand any part of these terms, you must contact our support team by opening a support ticket before placing an order or using our services.


2. Service Contract and Renewal

Unless otherwise stated, all services are provided on a recurring subscription basis and will automatically renew according to the selected billing cycle until cancelled by the client.

The client is responsible for ensuring that payments are made on time. If payment is not received by the due date, the related service may be suspended, cancelled, or terminated in accordance with these terms.

Upon cancellation, non-payment, or service termination, the service may be suspended or cancelled. Data related to suspended or cancelled services may be permanently deleted after the applicable grace period stated in these terms.


3. Limitation of Liability

Point of Trade Co. shall not, under any circumstances, be liable for any direct, indirect, incidental, special, consequential, financial, or other damages arising from or related to:

  • Loss of service
  • Loss of revenue or earnings
  • Loss of profit
  • Loss of data
  • Hardware or software failure
  • Service interruption
  • Network issues
  • Security incidents
  • Following advice or guidance provided by our staff
  • Termination or suspension of services
  • Any act or omission related to the use or inability to use our services

Clients are solely responsible for maintaining their own external backups and business continuity arrangements.


4. Client Acknowledgement

By using Point of Trade Co. services, the client acknowledges and agrees that:

  • Services may be interrupted, suspended, degraded, or unavailable due to circumstances within or outside our control.
  • Point of Trade Co. shall not be held liable for damages resulting from service disruption or downtime.
  • The client is solely responsible for maintaining secure and complete external backups of all data.
  • The client must not share account login details with third parties, except through authorized sub-user or contact accounts where supported.
  • The client agrees to receive service-related emails, account notifications, invoices, announcements, and occasional marketing communications.
  • The client may request to stop receiving marketing communications by contacting support, where applicable.
  • Any abusive, defamatory, harmful, or malicious conduct directed toward the company, its employees, or its services may result in immediate suspension or termination without refund.

5. Support Policy

Support is provided through our official online support ticket system.

Support tickets may be submitted 24/7. Our team will make reasonable efforts to respond as quickly as possible. Any stated response time is an estimate only and is not guaranteed, as response times may vary depending on the nature, complexity, and volume of support requests.

Point of Trade Co. provides support only for services directly offered by the company. Assistance with third-party software, plugins, mods, scripts, or applications may be provided at our discretion but is not guaranteed.

5.1 Customer Conduct Toward Support Staff

Clients must communicate with support staff respectfully and professionally.

Point of Trade Co. reserves the right to refuse service, suspend support access, or terminate services where a client engages in:

  • Threatening behavior
  • Abusive or offensive language
  • Aggressive communication
  • Harassment
  • Personal insults
  • Discriminatory remarks
  • Repeated unreasonable demands
  • Any conduct that causes distress to staff

Serious cases may be reported to the appropriate authorities.


6. Game Server Terms

Clients using Point of Trade Co. game server services agree to the following:

  • Advertising other server providers through our services is strictly prohibited and may result in suspension or termination.
  • Bandwidth, storage, and resources provided with game servers must be used only for game server-related files and operations.
  • Game server executable files may not be modified without prior written permission from Point of Trade Co.
  • Updating server files from legitimate and official sources is permitted.
  • Bots, add-ons, scripts, or modifications that significantly increase CPU, RAM, disk, or network usage are not permitted without prior approval.
  • Clients may only use the number of slots they have purchased. Unauthorized slot editing may result in immediate termination.
  • Mods and plugins are not fully supported. Our support team may assist with installation or configuration on a limited best-effort basis.
  • Point of Trade Co. is not liable for downtime, instability, or service issues caused by mods, plugins, third-party files, or unsupported changes.
  • We do not guarantee the availability, compatibility, or update timing of mods or plugins.
  • If a mod becomes outdated or causes issues, the client may request that the server be restored to default files and settings by opening a support ticket.
  • We may attempt to add third-party mods requested by clients but make no guarantee that every mod can be installed.
  • No refund will be provided if a requested third-party mod cannot be installed, unless the base game service itself is not functioning.
  • Downgrading a service may result in account credit for any applicable difference, subject to our refund and credit policies.
  • Point of Trade Co. reserves the right to update services and pricing after management approval.

6.1 DDoS, DoS, and Network Attacks

If a game server receives DDoS, DoS, IP stressor, or any other form of network attack, traffic may pass through mitigation systems.

If attacks continue, repeat, or threaten our network stability, Point of Trade Co. may apply a blackhole/null-route to the affected service without prior notice. This may cause the client’s server to become temporarily unreachable until our network team determines that the attack is no longer active.

The client is responsible for the users, files, applications, and activity running on their server. If the client’s use violates our security measures or causes damage to our infrastructure, Point of Trade Co. reserves the right to suspend or terminate the service without refund.


7. Web Hosting Terms

Clients using Point of Trade Co. web hosting services agree that their accounts, websites, and sub-accounts must not be used for:

  • Hosting material that violates any applicable law or regulation in the country or region where the server is located, including Kuwait, GCC countries, and the Middle East
  • Hosting backups, large video files, file dumps, or download repositories
  • Hosting copyrighted software, media, or content without authorization from the copyright holder
  • Hosting adult, racist, hateful, or discriminatory content
  • Hosting political, defamatory, infringing, or harmful content of any kind
  • Running proxy servers, bots, mass mailers, or similar automated tools
  • Hosting hacking, phishing, phreaking, malware, virus, spam, exploit, or security-bypass tools
  • Performing or facilitating activities that degrade server performance or negatively affect other customers
  • Testing the security of any server, website, device, network, or system without authorization

Unlimited file hosting, where offered, applies only to files directly related to the client’s active website. Point of Trade Co. reserves the right to apply limits or restrictions where usage is excessive, abusive, or unrelated to the intended hosting service.

Clients are responsible for maintaining their own website and database backups. Point of Trade Co. is not responsible for restoring lost data where the client has failed to maintain proper backups.

Security testing, scanning, exploitation attempts, or similar activities may result in immediate termination without refund and may be reported to the relevant authorities.

7.1 Agency Hosting

Agency Hosting clients may be required to submit an official ID, commercial license, or other verification documents after placing an order.

If required documents are not submitted, the order may remain pending and inactive until the necessary documents are provided.

7.2 Hosting Plan Limitation

Each hosting plan requires a separate hosting account due to module limitations. Multiple hosting plans cannot be placed under the same hosting account.

If a client wishes to purchase multiple hosting plans, separate registrations using different email addresses may be required.

If multiple plans are purchased under one account by mistake, the client must create a new account and submit a support ticket to request migration of the order to the newly created account.


8. Cloud Server Terms

Clients using Point of Trade Co. cloud servers agree that their cloud servers must not be used for:

  • Hosting material that violates applicable laws or regulations in Kuwait, GCC countries, the Middle East, or the server location
  • Hosting backups, large video files, public downloads, or file storage unrelated to the service purpose
  • Hosting copyrighted software or media without authorization
  • Hosting adult, racist, hateful, or discriminatory content
  • Hosting political, infringing, defamatory, or harmful content
  • Running proxy servers, bots, or unauthorized automated systems
  • Hosting hacking, phishing, phreaking, malware, spam, exploit, or malicious tools
  • Any activity that degrades the performance, stability, or security of our servers or network
  • Launching DoS, DDoS, scanning, abuse, or attack traffic against any person, company, server, or network

8.1 DDoS and Abuse Handling

DDoS, DoS, IP stressor, or similar attacks directed at a cloud server may invalidate any applicable money-back guarantee.

Traffic may be filtered through mitigation systems. If attacks continue, repeat, or create risk to our infrastructure, Point of Trade Co. may apply a blackhole/null-route to the affected service without prior notice. This may cause the service to become unreachable until our network team confirms that the attack has stopped.

The client is responsible for all applications, software, users, and activities running on their cloud server. If security rules are violated or the service causes damage to our infrastructure, we reserve the right to suspend or terminate the service without refund.

8.2 Windows Licensing

Windows cloud servers are provided without an included Windows license key unless expressly stated otherwise. The client is responsible for providing and maintaining any required operating system license according to the selected Windows version.


9. VPN Terms

Point of Trade Co. provides VPN services subject to responsible and lawful use. These rules apply equally to all VPN users regardless of package or plan.

We reserve the right to suspend or terminate VPN access at our sole discretion if the service is misused, abused, or used in a way that may harm others, violate laws, or damage our network or reputation.

Clients agree not to use the VPN service for:

  • Any illegal activity under local, national, international, or applicable laws
  • Sending spam, bulk unsolicited emails, or unauthorized marketing
  • Port scanning, open proxy scanning, open relay scanning, or similar activity
  • Hosting or serving pop-up advertisements
  • Attacking, disrupting, or attempting to compromise any computer, server, system, or network
  • Transmitting unlawful, harmful, threatening, abusive, harassing, defamatory, or objectionable content
  • Harassing, threatening, stalking, abusing, or harming any person or business
  • Forging headers, masking origins, or manipulating identifiers for unlawful purposes
  • Unauthorized advertising, promotional campaigns, or marketing activities
  • Distributing viruses, malware, spyware, ransomware, or other harmful software
  • Violating the policies of networks connected to our services
  • Discriminatory, abusive, insulting, hateful, or harmful activity
  • Submitting false or misleading information
  • Violating intellectual property rights
  • Promoting illegal activity or providing instructions to assist unlawful acts
  • Promoting violence, physical harm, or cruelty to animals
  • Concealing email recipients or abusing third-party communication systems
  • Encouraging others to participate in unlawful acts
  • Using scripts or automated tools to consume excessive resources
  • Reporting properly forwarded service messages as spam in a way that implicates our services
  • Creating excessive manual or automated connections to obtain different IP addresses or consume network resources
  • Using the VPN service for email forwarding that causes greylisting or abuse issues
  • Accessing, sharing, uploading, downloading, or streaming illegal content, including prohibited adult content
  • Using VPN IPs for automated searches, SEO manipulation, link building, forum commenting, crawling, scraping, or data mining unless expressly permitted
  • Uploading or transmitting malicious code
  • Collecting or tracking personal information of others
  • Spam, phishing, pretexting, spidering, crawling, scraping, or similar abuse
  • Obscene, immoral, or unlawful purposes
  • Interfering with or bypassing security features of our website, services, or third-party systems

Violation of this section may result in immediate suspension or termination without notice or refund.


10. Cloud Office Terms

Clients using Point of Trade Co. Cloud Office services agree that the service must not be used for:

  • Hosting or storing material that violates applicable laws or regulations in Kuwait, GCC countries, the Middle East, or the server location
  • Sharing copyrighted software or media without authorization from the copyright holder
  • Storing adult, racist, hateful, or discriminatory content
  • Storing political, infringing, defamatory, or harmful content
  • Hosting or storing hacking, phishing, phreaking, malware, virus, spam, exploit, or malicious tools

The client is responsible for all applications, files, users, and activities associated with their Cloud Office service.

If the client violates security rules or causes damage to our infrastructure, Point of Trade Co. reserves the right to suspend or terminate the service without notice and without refund.

Point of Trade Co. reserves the right to update Cloud Office services and pricing following management approval.


11. Refund Policy

Game servers, cloud servers, VPN services, and web hosting services may be eligible for a refund within 24 hours of activation if the client is not satisfied with the service, subject to the conditions below.

To request a refund, the client must submit a support ticket within the eligible refund period.

Refunds are subject to the following terms:

  • Payment gateway processing fees may be deducted from the refunded amount.
  • Processing fees are usually around 3% or more, depending on the payment method used.
  • Overpayments may be credited automatically to the client’s account.
  • Subscription payments older than 3 months cannot be refunded.
  • Pro-rata refunds are not provided unless expressly stated otherwise.
  • Account credit cannot be converted to cash or refunded, except where expressly permitted.
  • Public Pay payments are non-refundable.
  • A refund cannot be requested more than once for the same service.
  • Refund processing time depends entirely on the payment gateway and banking provider.
  • Estimated refund timelines are generally:
    • KNET: up to 3 business days
    • Credit cards and other payment methods: up to 10 business days

Refund eligibility may be voided where the service has been misused, abused, attacked, violated our terms, or used in a way that harms our network or other users.


12. Fair Usage Policy

Point of Trade Co. applies a fair usage policy to CPU, RAM, disk space, bandwidth, and other system resources where a specific limit is not otherwise stated.

If a client’s usage becomes excessive, abnormal, harmful, or noticeably impacts the stability or performance of our infrastructure, Point of Trade Co. may temporarily stop, suspend, or restrict the service for investigation and debugging.

If the issue is caused by Point of Trade Co., we may provide an appropriate resolution, which may include service restoration or a refund for the remaining unused period where applicable.

If the issue is caused by client abuse, misuse, or violation of these terms, the service may be terminated without refund.

This policy is applied at our discretion and generally only when necessary to protect service quality, stability, and other users.


13. Affiliate Terms

Affiliate users agree to the following:

  • Affiliate payout requests may cover a maximum of the last 6 months.
  • Any affiliate balance not claimed within 6 months may be converted to account credit.
  • Affiliates may not use paid advertisements to direct users to our website, including Google Ads, Facebook Ads, X/Twitter Ads, or similar paid platforms.
  • Affiliate payments are made by bank wire transfer only.
  • The payment recipient must match the name registered on the affiliate account.

Point of Trade Co. reserves the right to reject, suspend, or cancel affiliate commissions where abuse, fraud, misleading advertising, or violation of affiliate rules is suspected.


14. Account Information and Client Responsibility

Clients must provide accurate, complete, and truthful information during registration, including:

  • Full name
  • Address
  • Phone number
  • Country
  • Billing details
  • Any verification documents requested by Point of Trade Co.

If misleading, fake, incomplete, or inaccurate account information is detected, the client may be notified by support ticket.

If the client fails to correct the information, Point of Trade Co. reserves the right to suspend or delete the account, service, or server without further notice, where necessary.

Clients are responsible for all activity under their account, including activity by users, sub-users, administrators, or anyone with access to the service.


15. Cancellation Policy

All cancellation requests must be submitted online through the client area or official support system at least 1 day before the next due date.

Failure to cancel within the required period may result in the client being charged for the next billing cycle.

Cancellation does not automatically entitle the client to a refund unless the refund request qualifies under the Refund Policy.


16. Service Due Dates, Suspension, and Termination

Service duration is based on the billing cycle selected or the description provided for the service.

Point of Trade Co. does not allow overdue service usage. If payment is not received by the due date, the service may be automatically suspended after the final day of the active service period.

Suspended services may remain stored for a limited period. During suspension, files and settings may remain available temporarily.

If payment is not received after the suspension period, the service may be automatically terminated and all related data, files, and settings may be permanently deleted from our systems.

Once data is deleted, it cannot be restored.

16.1 Invoice and Payment Reminders

Invoices and reminders may be issued as follows:

  • Invoice generation: 7 days before the due date
  • First unpaid invoice reminder: 3 days before the due date
  • Second unpaid invoice reminder: last day before the due date

Clients may renew their subscription before the due date through the client area using the available renewal option.

Clients may also change their billing cycle through the client area where supported.

If payment is not received by midnight on the due date, the service may be suspended until payment is received. After the allowed suspension period, unpaid services may be terminated and deleted permanently.


17. Delivery Policy

All services provided by Point of Trade Co. are digital and non-physical. Therefore, no physical delivery is required.

Unless otherwise stated, services are usually provisioned within a maximum of 3 hours after payment confirmation and successful order verification.

Some services may require manual review, verification, license checks, or additional configuration, which may affect delivery time.


18. Payment Gateway Issues

If a client experiences any issue with a payment gateway, payment confirmation, failed transaction, delayed payment, or billing error, the client must contact support immediately by opening a ticket.

Where appropriate, our support team may place the service on hold while the payment issue is reviewed.

Claims that a payment gateway issue prevented payment may not be accepted after a service has already been terminated and deleted due to non-payment.


19. Changes to Services, Prices, and Terms

Point of Trade Co. reserves the right to update, change, amend, or modify:

  • These Terms of Service
  • Prices
  • Service features
  • Webpages
  • Policies
  • Support terms
  • Product descriptions
  • Service specifications
  • Any other service-related document or condition

Where pricing changes are made, we will make reasonable efforts to provide at least 1 month’s notice where practical.

Continued use of our services after changes are published constitutes acceptance of the updated terms.


20. Prohibited Applications and Activities

Point of Trade Co. reserves the right to prohibit, restrict, suspend, or remove any application, software, script, process, or activity that we consider unsuitable, harmful, abusive, unlawful, or likely to degrade the quality of service for other customers.

Any violation of these Terms of Service may result in account suspension, service termination, data deletion, and forfeiture of any refund eligibility.


21. Final Limitation of Liability

In no event shall Point of Trade Co. be liable to any client or third party for any consequential, direct, indirect, special, incidental, punitive, or other damages, including but not limited to loss of profit, revenue, data, goodwill, business opportunity, or service availability, whether arising from service unavailability, performance, non-performance, negligence, suspension, termination, breach, action, or inaction under these terms, even if Point of Trade Co. has been advised of the possibility of such loss or damage.


22. Governing Law and Jurisdiction

These Terms of Service shall be governed by and interpreted in accordance with the laws and regulations of the State of Kuwait, including applicable regulations related to communications and internet services.

Any dispute arising out of or relating to these Terms of Service, our services, or the client’s use of our services shall be subject to the exclusive jurisdiction of the courts of the State of Kuwait.
